I understand that all ticket purchases for the Wine & All That Jazz Festival are non-refundable and non-transferable. I agree to drink responsibly and acknowledge that I am responsible for my actions both during and after the Wine & All That Jazz Festival. In consideration of and as part of my payment for my right to attend and participate in the Wine & All That Jazz Festival, I hereby, to the greatest extent allowed by law, RELEASE Fund for the Arts, Spilman Thomas & Battle, the University of Charleston and all other companies, organizations and individuals providing services, products or support in any way to the Wine & All That Jazz Festival, including their directors, officers, agents, representatives, employees, volunteers and partners, performers, sponsors/promotional partners and vendors from any and all liability including, but not limited to, liability arising from negligence, gross negligence and/or reckless, willful or wanton conduct and INDEMNIFY and hold the same harmless from any and all liability, claims and demands of every kind and nature whatsoever which I may ever have arising, directly or indirectly, from attendance and participation in the Wine & All That Jazz Festival, including the same's defense costs and expenses. I consent to the use by Fund for the Arts, its directors, officers, agents, representatives, employees, volunteers and partners of photographs and video recordings made of me while attending and participating in the Wine & All That Jazz Festival without further compensation or acknowledgement by me, and agree that all such materials, including negatives or digital data, are the sole property of Fund for the Arts, its directors, officers, agents, representatives, employees, volunteers and partners. I ACKNOWLEDGE THAT I AM GIVING UP LEGAL RIGHTS, THAT I HAVE THE AUTHORITY TO AGREE TO THESE TERMS AND CONDITIONS ON THE BEHALF OF THOSE I AM PURCHASING TICKETS FOR, IF ANY, AND THAT I HAVE THE OPPORTUNITY TO CONSULT WITH AN ATTORNEY PRIOR TO PURCHASING A TICKET AND AGREEING TO THESE TERMS AND CONDITIONS.
